  4.             SUMMARY OF STATE LIVING WILL LEGISLATION

  6. ARKANSAS

  8. Synopsis: Arkansas has a weak living will statute, that in an
  9. apparent attempt to be "fair" allows living wills and "reverse
  10. living wills"- that is, declarations that every unusual means be
  11. used to prolong life. Arkansas is unique in having a provision
  12. for a "Living Won't!" The statute is not mandatory on doctors or
  13. hospitals and does not have any enforcement or transfer provisions.
  14. The statute allows the following persons to execute living (and 
  15. reverse) living wills for an incapacitated relative: parents of 
  16. minors; spouses; adult children (either the sole or the majority) 
  17. if a spouse will not do so. For those without parents or children 
  18. available, the "nearest living relative" may prepare a 
  19. declaration, as may a legal guardian. No form for a living will 
  20. is suggested or required. We suggest that you prepare a Uniform 
  21. living will. To prepare a Uniform living will, please select this
  22. option from the main menu. Please also consider executing a 
  23. living will for any State that you spend more than a few weeks 
  24. per year, or where you are a temporary resident.
